1. Acceptance of Terms

By downloading, installing, or using DealSpy ("the App"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, do not use the App. Your continued use of the App constitutes your acceptance of any updates or modifications to these Terms.

2. Description of Service

DealSpy is a deal aggregation and discovery platform that displays deals, discounts, and promotional offers from third-party online marketplaces and retailers ("Third-Party Stores"). The App collects and presents deal information for informational purposes only.

DealSpy does NOT:

• Sell, distribute, or ship any products
• Process payments or handle financial transactions
• Guarantee the availability, price, or quality of any product
• Act as an agent, representative, or partner of any Third-Party Store
• Provide warranties or guarantees on any listed product

When you click on a deal or "Buy Now" link, you will be redirected to the Third-Party Store's website or app, where you will be subject to that store's own terms of service, privacy policy, and return policy.

3. No Transaction Liability

ALL PURCHASES MADE THROUGH LINKS IN THIS APP ARE TRANSACTIONS SOLELY BETWEEN YOU AND THE APPLICABLE THIRD-PARTY STORE. DealSpy is not a party to any such transaction and assumes no liability whatsoever for:

• The accuracy of product descriptions, pricing, or images
• Product quality, safety, legality, or fitness for purpose
• Payment processing, billing errors, or unauthorized charges
• Shipping, delivery, delays, or lost packages
• Returns, refunds, exchanges, or cancellations
• Customer service or dispute resolution with any store
• Any damages, losses, or injuries resulting from products purchased

Any issues related to a purchase must be resolved directly with the Third-Party Store. DealSpy will not mediate, arbitrate, or otherwise involve itself in any transaction dispute.

4. Deal Information Accuracy

Deal information displayed in the App, including but not limited to prices, discount percentages, product availability, and expiration dates, is provided on an "as is" basis. While we strive to display accurate and up-to-date information, we make no representations or warranties regarding:

• The accuracy, completeness, or timeliness of deal information
• Whether a deal will still be available when you attempt to use it
• Whether displayed prices match current prices on Third-Party Stores
• The calculation of savings or discount percentages

Prices, availability, and deal terms are controlled entirely by the Third-Party Stores and may change at any time without notice to DealSpy or its users.

5. User Accounts and Conduct

You may create an account to access features such as commenting, liking deals, and syncing your wishlist. You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activity that occurs under your account
• Providing accurate registration information

You agree not to use the App to:

• Post false, misleading, defamatory, or offensive content
• Spam, harass, or abuse other users
• Impersonate any person or entity
• Scrape, crawl, or automatically extract data from the App
• Attempt to circumvent any security features
• Use the App for any unlawful purpose

6. User-Generated Content

By posting comments or other content through the App, you grant DealSpy a non-exclusive, royalty-free, worldwide license to use, display, and distribute such content within the App. You retain ownership of your content but are solely responsible for its accuracy and legality.

DealSpy reserves the right to remove, edit, or disable any user-generated content at its sole discretion, without prior notice, for any reason including but not limited to violation of these Terms.

7. Intellectual Property

The App, including its design, logos, code, and original content, is the property of DealSpy and is protected by applicable intellectual property laws. Product images, names, and descriptions displayed within deals belong to their respective owners and are used for informational purposes only.

8. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

DealSpy does not warrant that the App will be uninterrupted, error-free, secure, or free of viruses or other harmful components.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, DEALSPY, ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE APP.

IN NO EVENT SHALL DEALSPY'S TOTAL AGGREGATE LIABILITY EXCEED THE AMOUNT YOU HAVE PAID TO DEALSPY IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR FIFTY DOLLARS ($50), WHICHEVER IS LESS.

THIS LIMITATION APPLIES REGARDLESS OF THE LEGAL THEORY ON WHICH THE CLAIM IS BASED, INCLUDING BUT NOT LIMITED TO CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, OR ANY OTHER BASIS.

10. Indemnification

You agree to defend, indemnify, and hold harmless DealSpy and its officers, directors, employees, and affiliates from and against any and all claims, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to:

• Your use of the App
• Your violation of these Terms
• Your violation of any third-party rights
• Any content you post through the App
• Any transaction you enter into with a Third-Party Store

11. Third-Party Links, Services & Affiliate Disclosure

The App contains links to third-party websites and services. These links are provided for your convenience only. DealSpy does not control, endorse, or assume any responsibility for the content, privacy policies, or practices of any third-party websites or services. You access third-party sites at your own risk.

Affiliate Disclosure: As an Amazon Associate, DealSpy earns from qualifying purchases. Some links in the App may be affiliate links, meaning DealSpy may receive a small commission at no additional cost to you when you make a purchase through these links. Deal prices and availability are subject to change and are determined by the respective Third-Party Stores.

12. Termination

DealSpy reserves the right to suspend or terminate your account and access to the App at any time, with or without cause, with or without notice. Upon termination, your right to use the App will immediately cease. Sections regarding liability, indemnification, and disclaimers shall survive termination.

13. Modifications to Terms

DealSpy reserves the right to modify these Terms at any time. Changes will be effective upon posting within the App. Your continued use of the App after any changes constitutes acceptance of the revised Terms. We encourage you to review these Terms periodically.

14. Governing Law

These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles. Any legal action arising from these Terms shall be brought in the courts of competent jurisdiction.
